Litigation of counsel Martin Flumenbaum and firm Chairman Brad Karp’s latest Second Circuit Review column, “The Second Circuit In the Supreme Court,” appeared in the September 27 issue of the New York Law Journal. In their 39th annual review of the Second Circuit’s performance ahead of the new U.S. Supreme Court term, the authors compared the Second Circuit’s record of reversal in the past year with other circuit courts, and examined each of the Circuit’s seven cases before the Court. Looking ahead, they discuss two cases in the October 2023 term arising out of the Second Circuit: Murray v. UBS Securities, which presents a “retaliatory intent” question; and Harrington v.
