Litigation of counsel Martin Flumenbaum and partner Brad Karp’s latest Second Circuit Review column, “The Second Circuit in the Supreme Court,” was published in the New York Law Journal. In their 42nd annual review of the Second Circuit’s performance before the U.S. Supreme Court, the authors analyze the court’s treatment of eight Second Circuit cases during its previous term. These cases addressed significant issues including immigration, firearm convictions, double jeopardy, arbitration, securities regulation, compassionate release, qualified immunity and constitutional law. The authors also examine the Supreme Court’s overall reversal trends and look ahead to three Second Circuit cases the court has agreed to hear in its October 2026 term, including matters involving trademark law, the constitutionality of restrictions on semiautomatic rifles and immigration.
