Jessica Carey, Roberto Gonzalez and Carly Lagrotteria Publish Article on Crypto Executive Order in Law360

Litigation partners Jessica Carey and Roberto Gonzalez and associate Carly Lagrotteria co-wrote an expert analysis, “Executive Order Is First Step In Supporting Digital Assets,” published in Law360. The article discusses President Biden’s new executive order that lays out a first-of-its-kind, whole-of-government approach to supporting digital asset innovation, studying and mitigating digital asset risks, and reinforcing U.S. leadership in this area.

“While recognizing the many risks and uncertainties posed by the growth of cryptocurrencies and distributed ledger technologies, the executive order and related statements issued by the administration can be read as supportive — and even embracing — of digital assets,” the authors write. “It appears that one overriding motivation for the executive order was the administration's desire for the U.S. to retake a leadership role in cryptocurrency innovation and potential regulation and standard-setting on a global level.”

The authors go on to discuss the practical impacts of the executive order and the Treasury’s leading role in this new national policy, among other topics.
