Litigation partner Catherine Nyarady’s latest intellectual property litigation column, “Supreme Court To Decide Constitutionality of Appointment of PTAB Judges, ” appeared in the November 18 issue of the New York Law Journal. The authors discuss an upcoming Supreme Court decision that will decide whether the Federal Circuit correctly held that the appointment of Administrative Patent Judges was unconstitutional. Catherine suggests that the decision, while important for the judges in the Patent Office and the future of inter partes review proceedings, could also have a significant impact on the power of administrative law judges in other federal agencies.
