Patent Litigation

Patent Litigation

At Paul, Weiss, we are privileged to advise industry-leading companies, helping them address complex issues and drive technological advancements. Our core strength lies in our ability and confidence to go to trial, with a deep bench of experienced trial lawyers who represent companies in their most significant matters, protecting their intellectual property and launching products. Our lawyers combine extensive courtroom and boardroom experience with a thorough understanding of science and technology.

Unlike other patent litigation firms, Paul, Weiss specializes in matters of strategic importance across a broad range of industries, focusing exclusively on these critical issues. Our trial experience spans every forum:

  • We have tried a broad range of jury and bench trials in courts across the country.
  • We have tried arbitrations relating to patents around the world.
  • We have tried Section 337 patent infringement litigations before the U.S. International Trade Commission.
  • We have tried inter partes review (IPR) and covered business method (CBM) proceedings before the Patent Trial and Appeal Board (PTAB), and helped persuade the PTAB not to institute such proceedings.

Our appellate practice is robust, defending our victories in the U.S. Court of Appeals for the Federal Circuit and the Supreme Court. We are also hired on appeal to defend or challenge verdicts from trials in which we did not participate.

Our team includes leading trial lawyers and Patent Office practitioners, adjunct professors of patent litigation, former patent examiners, former Federal Circuit law clerks, and lawyers with advanced degrees in various scientific disciplines. Many of our lawyers hold multiple accolades.

We draw from deep expertise in fields such as chemistry, immunology, molecular and cellular biology, physics, computer science, and various engineering disciplines. Our experience spans a wide range of products and technologies, including:

  • Biologics, including bespoke antibodies, vaccines, and recombinant analogues to human proteins used to treat autoimmune disorders, cancers, bleeding disorders, and other life-threatening diseases and conditions, as well as the methods by which these and other biologics are created, purified and manufactured;
  • Communications, electronics and computing products, including telecommunications software, internet method/information storage systems, computer network management software, LEDs, LDs, alkaline and hearing aid batteries, CDs and DVDs, audiotape cassette technology, word processing, barcode and machine vision technology, semiconductors, flat-panel display technology and fiber optics;
  • Consumer products, including shaving products, cosmetics, hair dryers, toothbrushes, aerosols and in-mold labeling tubes;
  • Industrial technologies, including chemical products and processes, mechanical sensors, automotive drive systems, fabrics, corrugated paper, machinery, paper stock washers, color correction equipment, electrical generators, spindle motors and rare-earth magnets;
  • Medical devices, including transcatheter heart valves, surgical staples, catheters, hip and knee prostheses, cryosurgical devices and medical diagnostic tests; and
  • Pharmaceuticals, including established innovative small-molecule drugs facing generic challenges and new drugs at the leading edge of development, from antipsychotics to dermatologic treatments to drugs for rare vision disorders and autoimmune diseases.

"The Paul Weiss team is very experienced and knows how to dissect complex litigation matters to distinguish the most important issues from the rest and allocate resources accordingly."
