Transactional Real Estate: Transit-Related Zoning Programs

Real estate partners Salvatore Gogliormella and Peter Fisch’s latest transactional real estate column, “Transit-Related Zoning Programs,” appeared in the May 12 issue of the New York Law Journal. The authors discuss zoning changes recently proposed by the Department of City Planning and the Metropolitan Transportation Authority that would make New York City’s mass transit system more accessible to individuals with ambulatory disabilities and mobility limitations. The authors outline the transit-related zoning programs currently in place and discuss the proposed accessibility-related amendments to the city’s Zoning Resolution, which would require transit easements on a system-wide basis and would incentivize the construction by private owners of significant transit improvements (such as station elevators and entrances) by expanding transit improvement bonus programs in high-density areas.
