Chair of the Artificial Intelligence Practice Katherine Forrest’s latest Technology Today column, “Persuasiveness Is a Tool Not Just for Lawyers,” appeared in the June 16 issue of the New York Law Journal. In the article, Katherine discusses the “double-edged sword” of AI’s fast-growing powers of persuasion – increasingly outperforming human persuasion – and the opportunities and ethical dilemmas this ability presents for lawyers. AI’s persuasive power is built on its abilities to analyze vast droves of user data and datasets of human behavior, develop anthropomorphism and rapport, and exercise unlimited patience. While AI “persuaders” might be able to amplify a lawyer’s persuasive power, they are no replacement for a lawyer’s judgment; lawyers adopting AI tools should remain mindful of their code of professional responsibility, Katherine writes, and consider taking actions such as building transparency and user control into AI systems to mitigate potential dangers.
