Litigation of counsel Martin Flumenbaum and firm chairman Brad Karp’s latest Second Circuit Review column, “The Second Circuit In the Supreme Court,” appeared in the September 22 issue of the New York Law Journal. In their annual review of the Second Circuit’s performance ahead of the new Supreme Court term, the authors discuss high-profile cases heard by the Supreme Court over the past year; the loss of former Second Circuit Chief Judge Robert Katzmann, who passed away in June; and the elevation of Supreme Court Justice Amy Coney Barrett. Looking ahead to the 2021 term, they discuss two merits cases arising out of the Second Circuit: New York State Rifle & Pistol Association v. Corlett, on whether New York’s denial of concealed carry licenses violates the Second Amendment, and Thompson v. Clark, on whether an individual needs to prove their innocence before they can sue a police officer for an unreasonable arrest.
