Real estate partners Peter Fisch and Salvatore Gogliormella’s latest Expert Opinion column, “New York Restricts the Use of Algorithms in Setting Rents,” appeared in the October 28 issue of the New York Law Journal. The authors discuss New York’s new Assembly Bill 1417-B, which amends the Donnelly Act to prohibit the use of algorithms and software to coordinate in setting residential rents and lease terms. They note that, at a time when the real estate industry is actively adopting AI tools to gain a competitive advantage, the new law signals heightened antitrust regulatory scrutiny of the design and deployment of any AI algorithms in residential leasing processes.
