Attorneys Shouldn’t Rely Solely on AI for Case Citations, Katherine Forrest Tells Law360

Artificial Intelligence Group Chair Katherine Forrest spoke with Law360 about the cascade of judicial orders on the use of generative AI in the preparation of court filings, prompted by several instances in which attorneys have submitted court documents with fake case citations. In “Judges' AI Orders Keep Trickling In As Fake Citations Persist,” published on July 21, Katherine observes that lawyers do not appear to be taking the courts’ warnings about AI seriously. Katherine, who previously served as a federal district judge for seven years, also highlights a broader concern—the tendency of lawyers to cite cases in court filings without thoroughly reviewing them.

“Sometimes your law clerk finds it and says, ‘Well, no, that deposition citation doesn’t say that at all. It says X. And they’ve said it says Y,’” Katherine says. With attorneys becoming overly reliant on generative AI tools, Katherine also warns that new problems will emerge. “We need to not fall into the trap of thinking that the AI problems we have today are the AI problems we’re going to see tomorrow,” she says.
