Real estate partners Mitchell Berg and Peter Fisch’s latest transactional real estate column, “The Death of the Bottom-Dollar Guarantee,” appeared in the May 8 issue of the New York Law Journal. The authors discuss the Treasury regulations concerning partnership recourse liabilities and the impact of those regulations on the use of so-called ‘bottom-dollar guarantees’ in real estate partnerships.
