Digital Technology Group Chair Katherine Forrest was featured in a Bloomberg Law article about challenges in determining legal liability associated with the use of artificial intelligence. In “Emerging AI Models Challenge Liability Law With Little Precedent,” published on April 16, Katherine says that “negligence lawsuits … will be fought out in the courts about whether or not there is a tool which is acting in a way that somebody should have known was going to be harmful and didn’t take appropriate steps.” Though there is uncertainty about how these lawsuits will turn out, Katherine predicts that common law will adapt to these new technological developments, as it has before. Among other things, contractual arrangements will be crafted to determine where the “liability baton” gets passed from developer to user, Katherine says.
