Digital Technology Group Co-Chair Katherine Forrest spoke with Bloomberg Law about how to navigate disclosure of the use of generative AI in client work. In “Law Firms Wrestle With How Much to Tell Clients About AI Use,” published on November 29, Katherine notes that while lawyers’ duties of confidentiality and competence sufficiently cover their obligations to clients while using AI tools, disclosing AI use isn’t “necessarily a bad thing, and it may in fact be prudent during this interim phase, while we’re all getting used to this new transformed world with new tools.”
Whether or not firms choose to disclose their use of generative AI, “ultimately, you follow your client’s instructions” around their comfort level with the technology, Katherine says.
