In the latest issue of the Restructuring Department Bulletin, we highlight recent decisions impacting the restructuring arena, including an order in the Southern District of New York finding that U.S. bankruptcy courts overseeing Chapter 15 cases may recognize and enforce foreign court-sanctioned restructurings that discharge New York Law-governed debt; a Fifth Circuit holding that a debtor may reject regulated energy contracts in spite of FERC regulatory disapproval; and a Western District of North Carolina holding that fraudulent transfer provisions of the FDCPA are not available to Chapter 7 trustees where debt is not owed to the U.S.
